CEDAW issues

1.皇室典範の改正

第１条　皇位は、皇統に属する男系の男子が、これを継承する。

2.従軍慰安婦問題(戦時売春婦)

Mandate to accept same number applicants from male and female.

妻が婚姻中に懐胎した子は、夫の子と推定する。

現時世界各地的狀況
夫婦別姓的國家：韓國、朝鮮、中國、越南、西班牙、中華民國。
夫婦同姓的國家：法國、英國、印度、日本、美國。
兩者皆可的國家：瑞典。

Q. Does general opinion of Committee on the Elimination of Discrimination against Women has a legal binding?

A. There are no precedent. But CEDAW could have a legal binding based on International Covenant on Civil and Political Rights percedent that have been sentenced at International trial on human rights in Japan(Osaka Kousai Hanketsu 1994/10/28 Ne dai 1290 gou songaibaisyouseikyuukousojiken Hanji 1513gou 71 kou, Han ta 868gou 59kou).

Does CEDAW clash against the Article 98 of the Constitution of Japan??

No.

Is CEDAW a self-executing convention???

Possibly yes.

9.Practically Zainichi-Korean Optional Protocol

In Japan, practically, issues of the International Human Rights equal to Zainichi-Koeran issue.

10.Karuderon issues

Dont know. Need more research.
